Q: What is the relationship between AMS Staff Leasing and its client companies?
A: By contract, AMS assumes the employer's responsibility for its client’s current and future work force. As the employer, AMS provides Workers Compensation insurance, payroll, makes all tax filings, and administrates all legal and regulatory issues related to the employees. The client company remains in control of how it uses the employees to maintain its daily operations. The fee to AMS for services rendered by these employees is built into the reduced labor burden rate quoted to the client by AMS.
Q: What is the benefit of using this program for my company?
A: The client company is benefited in three main areas.
1: Reduction in direct labor burden costs.
2: Reduction in time and money spent in fighting questionable workers compensation claims.
3: Reduction in costs and time expended on payroll related functions and regulatory requirements.
Q: How does the program work?
A: The program transfers the employment responsibility of the client company's current and future workforce to AMS. The client company contracts with AMS to supply that workforce to the client for a fee which is a percentage of the total gross payroll, based upon that client’s specific work classifications. All costs are figured into the client company's total labor burden.It is important to note that the client retains control of the workforce with regard to daily operations, hiring, termination, and wage decisions. When a client no longer has a use for an employee, they do not ‘fire’ said employee, but rather have the employee call AMS for re-assignment and the employee no longer deals with the client company.
Q: How is the program set up and maintained?
A: The program is easy to set up. Employees are asked to fill out AMS applications, I-9's, and W-4's. They are instructed in detail as to the nature of their new employer to avoid confusion and employee apprehension. The client is entered into the computer system and an account is established. Payroll for the new client will be generated according to the client's specifications AMS will generate payroll every pay period for their employees. An invoice for the gross payroll plus labor burden will be generated and faxed to the client. At the time the client company requests payroll to be delivered, the client will deliver certified funds in the amount of the total invoice to AMS.
Q: What type of insurance coverages are used?
A: Our Workers Compansation Insurance coverage is provided through either Dallas Fire, Imperial, or Providence, depending on which state the client company is located, in the 24 states nationwide we can provide coverage/services to. Coverage amounts total $1,000,000 across the board statutory limits. Coverage cost is included in the total fee paid for by the client company. There are no up front deposits required or fees for things such as certificate issuance or certified payrolls.

Q: What about employee benefits?
A: We do not offer any additional employee benefits (such as health insurance, 401k, etc) but we can make the appropriate deductions from the employee and rescind that amount from the total invoice to the client for client's existing plans.
Q: What happens when a work related injury occurs?
A: AMS will respond immediately to any claims made. The employee's welfare is our first concern, and it is always our intent to help the injured worker rehabilitate and return to work as soon as possible without suffering financial loss. If litigation is imminent, AMS will coordinate all correspondence through its legal representatives and the legal staff of its insurer's.
Q: How do I know my tax deposits are being made?
A: AMS will provide proof of tax deposits upon request of the client company. In addition, the client company may call or write our banker and our CPA for confirmation. The client company may also confirm through the proper federal and state agencies that AMS is in fact current on its payment of 941 and quarterly taxes.
Q: What happens if I want to suspend the program?
A: The client company may terminate its relationship with AMS at any time. AMS does not require long term contracts. The client company needs only to stop sending payroll, and provide written notice of contract termination indicating the effective date the client would like services terminated.
Q: What about renewals and policy expirations?
A: Once a client is signed up with AMS, the relationship goes forward, continuously, with no breaks. AMS is responsible for renewing the insurance policy and will provide renewal certificates immediately after policy renewal. The goal is to have a seamless transition that affects the client as little as possible. We do not re-rate the client upon our insurance policy renewal.
